On March 14, 2020, the Supreme Court of Georgia entered an Order declaring a state of “judicial emergency” through and including April 13, 2020, which order “suspends, tolls, extends, and otherwise grants relief from any deadlines or other time schedules or filing requirements imposed by otherwise applicable statutes, rules, regulations, or court orders.”
In addition, the school district office is closed pursuant to emergency closure until April 14, 2020. Based upon the foregoing, requests for records under the Open Records Act received during this emergency closure will be considered tolled until April 13, 2020, unless otherwise ordered.
According to the Georgia Open Records Act (O.C.G.A. §50-18-70, et seq.), public records are available for inspection and copying unless they are exempted from disclosure under the law.
All open records requests to inspect or copy records must be made in writing to the Open Records Officer, Nancy Sowell.
The school district will provide a response to the request as permissible under the law, within 3 business days after it has been received by the Open Records Officer. If production of the information is not possible within that timeframe, the Open Records Officer will issue correspondence with an explanation.
If a government agency or custodian of public records withholds a public document from production under an Open Records Request, they will cite to the provision of Georgia Law that exempts the record from being produced.
Please note that Burke County Public Schools charges reasonable fees for the production of records in accordance with the Georgia Open Records Act.
